Residential Service Agreement
This Service Agreement ("Agreement") is entered into between Poopsie Daisy ("Provider," "we," "us") and the customer ("Client," "you") for recurring pet waste removal service at the service address Client provides at signup. By signing up for service online, confirming a plan with Provider, or accepting the first scheduled visit, Client agrees to the terms of this Agreement.
1. Service Description
- Provider will visit Client's property on the agreed schedule (weekly, bi-weekly, or as otherwise arranged) to scoop, bag, and remove pet waste from the yard, placing it in Client's own outdoor trash receptacle unless other arrangements are made.
- Provider does not guarantee a specific time of day for service — only the agreed day(s) of the week.
- Standard pricing covers a typical residential lot up to approximately ¼ acre. Larger lots carry a per-visit surcharge, shown in the price calculator at poopsiedaisyaz.com/pricing or in Client's quote. Lots over ¾ acre, and yards with unusually rocky, overgrown, or difficult terrain, are quoted individually before service begins.
- An initial cleanup fee applies to any yard that has not been picked up within the last two weeks. It is billed separately from the recurring rate, at the pricing in effect at the time of signup (see the price calculator at poopsiedaisyaz.com/pricing or Client's quote), and is confirmed after Provider assesses the yard.
- Client is responsible for informing Provider of any change in the number of dogs/pets at the property, as pricing is based on pet count. Provider is not obligated to issue retroactive credit for undisclosed decreases in pet count.
2. Property Access
- Client authorizes Provider (and its employees or authorized helpers) to enter the yard/property for the sole purpose of performing the scheduled service.
- Client is responsible for ensuring gates are unlocked and accessible on the scheduled service day. If Provider cannot access the yard (locked gate, inaccessible entry, or unsafe condition), the visit will be marked as attempted and billed at the normal rate — no credit or refund will be issued for access-related missed visits.
- If Client's own outdoor trash receptacle is inaccessible, locked, missing, or already full on the scheduled service day, Provider will bag the waste and leave it in a clearly visible location near the gate or entry point. The visit is billed normally; Provider is not responsible for waste left this way being disturbed by animals, weather, or others before Client retrieves it.
- Provider is not responsible for pre-existing damage to gates, fences, or latches, and will not be held liable for normal wear from opening/closing a gate as part of routine service. If Provider notices a gate or fence in need of repair, we will make a reasonable effort to notify Client.
3. Pet Safety & Behavior
- Client agrees to keep aggressive, reactive, or easily-startled dogs secured away from the service area (e.g., indoors or in a separate enclosure) during the scheduled visit window.
- Provider is not responsible for a pet that escapes through a gate left open by Client, a pre-existing broken latch/fence, or other conditions outside Provider's control.
- If a technician reasonably believes entering the yard is unsafe due to an unsecured or aggressive animal, the visit may be skipped and billed at the normal rate; Client will be notified as soon as practical.
- Provider carries general liability insurance; in the rare case of an insured incident directly caused by Provider's negligence, Client should contact Provider promptly to initiate a claim.
4. Health, Safety & Yard Conditions
- Provider reserves the right to decline or pause service, without billing Client for the skipped visit, if the property shows visible signs of an active flea, tick, or other pest infestation; a communicable illness affecting pets on the property; or any biohazard condition. Provider will notify Client of the reason and the condition(s) that need to be remedied before service can resume.
- Provider reserves the right to decline entry, without billing Client for the skipped visit, when yard conditions present a genuine safety hazard — including but not limited to standing water, construction debris, exposed sharp materials, or overgrowth severe enough to obscure the ground underfoot. Client will be notified and given the opportunity to remedy the condition before the next scheduled visit.
- Loose stool. Provider will remove loose or liquid stool to the extent reasonably possible. This may include removing small amounts of rock, gravel, mulch, or soil the waste has soaked into, and applying an absorbent material and/or pet-safe cleaner to the affected area. Some residue, staining, or odor may remain, particularly on rock, artificial turf, or concrete. Provider is not responsible for replacing removed landscape rock or ground cover, or for residual staining. Any waste that cannot be fully removed during a visit will be addressed again at the next scheduled visit.
- As a courtesy, Provider may notify Client when loose stool is observed, since it can be a sign a pet isn't feeling well. This notice is not a veterinary assessment. Client agrees to let Provider know if any pet on the property is diagnosed with a contagious illness (such as parvovirus or giardia), so Provider can take extra sanitation precautions to tools and footwear between properties.
- Repeated occurrences of either of the first two conditions above, at the same property, may result in a required re-inspection fee, a rescheduled initial-cleanup-rate visit, or termination of service at Provider's discretion.
5. Weather & Missed Visits
- Service generally proceeds as scheduled in light rain. In the case of severe weather (heavy storms, extreme heat advisories, or unsafe road conditions), Provider may reschedule to the next practical day and will make reasonable efforts to notify Client of the change.
- If Provider must skip a visit for reasons within Provider's control (illness, vehicle trouble, etc.), and is unable to reschedule within two days of the originally scheduled visit, Client's next bill will be credited accordingly.
- Poop-Free Guarantee. If Client notices waste that was missed during a scheduled service, Client may let Provider know by call, text, or email, ideally as soon as it is noticed and before the next scheduled visit. Provider will correct it at no additional charge, typically with a return visit, or at the next scheduled visit if Client prefers. The guarantee covers areas of the yard that were accessible and reasonably visible at the time of service. It does not cover waste deposited after the visit (Provider's post-visit photos may be used to confirm the yard's condition at completion); loose stool residue or staining (see Section 4); or areas affected by heavy rain, flooding, standing water, excessive overgrowth, leaves or debris, locked or inaccessible areas, or pets that could not safely be worked around. The remedy for missed waste is a free correction rather than a refund or credit.
6. Holiday Schedule
- Provider observes a short list of major holidays each year (e.g., New Year's Day, Memorial Day, July 4th, Labor Day, Thanksgiving, Christmas Day) during which regularly scheduled visits falling on that date will be shifted to the next practical service day at no additional charge. Provider will post the current year's observed holiday schedule in advance.
7. Pausing, Vacation Holds & Cancellation
- This is a no-contract, cancel-anytime residential service. Client may cancel service at any time by notifying Provider. There is no cancellation fee.
- If Client cancels, any visits already paid for but not yet performed are refunded on a prorated basis.
- Provider asks for at least 24 hours' notice before the next scheduled visit to cancel or pause service, to avoid being billed for a visit already in progress or completed.
- Client may pause recurring service for any reason, and at any time (no explanation needed), provided advance notice of at least 24 hours has been given. A pause of up to 3 consecutive weeks resumes at the standard recurring rate. A pause longer than 3 weeks will resume with the applicable initial-cleanup/backlog fee (Section 1), based on the accumulated volume, since a longer gap results in a genuinely larger cleanup, regardless of the reason for the pause.
8. Payment Terms
- Recurring service is billed monthly, in advance, at the rate agreed at signup, to the payment card Client keeps on file in Provider's secure client portal. Initial cleanups, one-time cleanups, and add-on services are charged to the same card.
- Client is responsible for keeping a valid payment card on file. Receipts are sent electronically.
- If a payment fails and the balance is not brought current within 14 days, service may be paused until it is.
- Existing rates are reviewed annually and may be adjusted to reflect changes in the cost of operating the business. Client will receive at least 30 days' advance notice (email or text) before any rate change takes effect; continued use of service after the notice period constitutes acceptance of the new rate.
- Promotional or discounted pricing, where offered, applies only for the period stated in the offer. After that period, Client's rate is the then-current standard rate. Promotional pricing is not guaranteed indefinitely.
9. Limitation of Liability
- Provider's liability, to the extent permitted by law, is limited to the cost of the service visit in question. Provider is not liable for indirect, incidental, or consequential damages arising from service.
- This Agreement does not waive any rights Client may have under Provider's general liability insurance policy for a covered incident directly caused by Provider's negligence.
10. General
- This Agreement may be updated by Provider from time to time; Client will be notified of material changes.
- This Agreement is governed by the laws of the State of Arizona.
